Terms of Service

"Tezeract", "we", "us" refers to Tezeract, Inc., a Delaware corporation. Reach us at support@tezeract.com for support, or legal@tezeract.com for legal notices.

You must be at least 18 years old, or have a parent or guardian agree on your behalf, to purchase from us. Account credentials are yours to keep secure — you're responsible for activity under your account.

• Tezeract Console — $129 USD, one-time purchase. Includes the device, cables, and a magnetic privacy cover.
• Tezeract+ — $9.99 USD per month, optional recurring subscription for premium fitness content, security cloud DVR, and exclusive titles.
• Prices are listed in US dollars and do not include sales tax, which will be added at checkout where required. Shipping is free within the contiguous US for the launch.
• We may correct pricing errors at any time. If you've been charged an incorrect amount we'll either refund the difference or cancel the order and refund you in full.

• 30-day returns on the console. Return it in original condition within 30 days of delivery for a full refund, less return shipping if outside the US.
• Tezeract+ subscriptions can be cancelled at any time and take effect at the end of the current billing period. Partial months are not refunded except where required by law.
• Damaged or defective devices are covered by the 60-day limited warranty (Section 11) — contact support before returning.

Tezeract+ is billed monthly to your payment method on file via Stripe. By subscribing you authorize recurring charges until you cancel. We'll email you before any price change with at least 30 days' notice; if you don't cancel before the change takes effect, you accept the new price.

The Tezeract software (the operating system, launcher, motion engine, and any bundled games) is licensed, not sold, to you. We grant you a limited, non-exclusive, non-transferable, revocable license to use the software solely on your Tezeract device for personal, non-commercial use.

You may not reverse engineer the device or its firmware (except to the extent that right cannot be waived by law), redistribute the software, or use it to develop a competing product.

The Tezeract App Store hosts apps developed by third parties. We review them before listing, but we don't create them and we don't guarantee them. Your use of any third-party app is governed by that developer's terms.

If you believe an app violates our content policies or our developer agreement, email trust@tezeract.comand we'll investigate.

You agree not to:

• Use Tezeract for any unlawful or harmful purpose.
• Modify, tamper with, or circumvent the security features of the device or its software.
• Use the security features to surveil people who haven't consented to being recorded (the device is intended for use in spaces you control).
• Harass, threaten, or share content depicting minors in a sexual or exploitative way. We will report these to law enforcement.
• Resell, lease, or commercially redistribute the device.

All Tezeract trademarks, logos, and the Tezeract name are ours. You don't get a license to use them by purchasing the device. The content of tezeract.com is ours (or our licensors') and is protected by copyright.

If you send us feedback, suggestions, or ideas, you grant us a perpetual, royalty-free, irrevocable license to use them for any purpose, with no obligation of compensation or attribution.

We warrant that the Tezeract device will be free from defects in materials and workmanship for 60 daysfrom the date of delivery, under normal household use. If your device fails during that window, we'll repair or replace it at our option. This warranty doesn't cover damage from accident, misuse, or unauthorized modification.

Except as stated above, the device and all software are provided "as is" without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Tezeract's total liability arising out of or relating to these Terms or your use of the device is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.

We'd rather work things out informally. Please email support@tezeract.com first — most issues are resolved that way. If we can't reach an agreement within 30 days, any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Delaware. You and we both waive the right to a jury trial and to participate in a class action. Exceptions: either party may bring a claim in small-claims court if it qualifies, and either party may seek injunctive relief in court for intellectual-property infringement.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Subject to Section 13, any non-arbitrable disputes will be resolved in the state or federal courts of New Castle County, Delaware.

We may suspend or terminate your account or access to services if you breach these Terms in a serious or repeated way, or to comply with the law. If we do, we'll refund any prepaid but unused Tezeract+ subscription on a pro-rata basis. The device is yours either way.

We'll post material changes here at least 30 days before they take effect and email registered customers. Continued use after the effective date counts as acceptance.
